Terms and Conditions

1. Scope

These General Terms and Conditions (GTC) apply to all services, workshop bookings, shop purchases, and gift card transactions provided by Lume Studio GmbH ("Lume Studio"), Radetzkystrasse 8, 1030 Wien, Austria. By making a booking or purchase, you accept these terms.

2. Conclusion of Contract

A contract is concluded when you complete a booking or purchase through our website and receive a confirmation email. Workshop bookings are binding once confirmed. Shop orders are binding once payment has been successfully processed.

3. Prices and Payment

All prices listed on our website are final prices in euros (€). As a small business (Kleinunternehmer) pursuant to § 6 Abs. 1 Z 27 UStG, we do not charge value added tax (VAT). Payments are processed securely via Stripe. We accept major credit and debit cards.

4. Workshop Bookings

Cancellation policy:

• Public workshops: Free cancellation up to 10 days before the event. Cancellations less than 10 days before the event cannot be refunded.
• Rescheduling: Need a different date? Let us know at least 7 days before your workshop and we'll happily move your booking. We'll offer you a selection of our currently available dates and times to choose from.
• Minimum participants: If fewer than 4 people are booked for a public workshop, we may cancel it or offer you an alternative date. We will always let you know at least 3 days before the workshop.
• Private and corporate workshops: Free cancellation up to 3 weeks before the event. Cancellations less than 3 weeks before the event cannot be refunded, but rescheduling is possible subject to availability.
• You may transfer your booking to another person at any time. Please notify us by email at lumestudiovienna@gmail.com.

No-show policy: If you do not attend a booked workshop without prior cancellation, no refund will be issued.

5. Gift Cards

• Gift cards are valid for 12 months from the date of purchase.
• Gift cards can be redeemed for any workshop or shop product.
• Gift cards are transferable to other persons.
• Partially redeemed gift cards retain their remaining balance until expiry.
• Gift cards are not returnable or refundable, as each gift card is personalised with the recipient's name and a personal message.
• Cash payout of gift cards is not possible.

6. Shop Orders

Shipping and delivery

• We currently ship within Austria only. Delivery usually takes 3 to 5 working days.
• Shipping costs are shown before you complete your order (currently € 3.99 per order within Austria).
• Pickup at the studio (Radetzkystraße 8, 1030 Wien) is free of charge, by arrangement.

Right of withdrawal for consumers

You have the right to withdraw from a shop purchase within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you, or a third party named by you other than the carrier, received the goods. If you ordered several items that are delivered separately, the period starts when you receive the last item.

To exercise your right of withdrawal, you must inform us (Lume Studio GmbH, Radetzkystraße 8, 1030 Wien, Austria, lumestudiovienna@gmail.com, +43 676 7008716) of your decision by means of a clear statement, for example by email or letter. You may use the model withdrawal form below, but this is not required. To meet the deadline, it is sufficient to send your notice before the 14-day period has expired.

Consequences of withdrawal

If you withdraw, we will refund all payments we have received from you, including standard delivery costs, without undue delay and at the latest within 14 days from the day on which we receive your notice of withdrawal. We will use the same means of payment you used for the original transaction, unless expressly agreed otherwise; you will not be charged any fees for this refund. We may withhold the refund until we have received the goods back or you have supplied proof of having sent them back, whichever is earlier.

Please return the goods to us, or bring them to the studio, without undue delay and at the latest within 14 days from the day on which you notify us of your withdrawal. The deadline is met if you send the goods before the 14-day period has expired. You bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling that was not necessary to check their nature, characteristics and functioning.

Exception: workshops

There is no right of withdrawal for workshop bookings, as these are leisure services provided on a specific date (§ 18 Abs. 1 Z 10 FAGG). The cancellation policy in section 4 applies instead.

The statutory warranty rights apply to all products.

7. Liability

We run our workshops with the greatest care. Please follow the safety instructions of the workshop host, especially when handling hot wax and open flames. Working with clay, wax and paint can cause stains, so we recommend wearing clothes you do not mind getting dirty.

We are liable for damage caused intentionally or through gross negligence. For personal injury, we are also liable in cases of slight negligence. For other damage, such as stains on clothing, liability for slight negligence is excluded. Mandatory statutory liability, in particular under the Austrian Product Liability Act (Produkthaftungsgesetz), remains unaffected.

9. Final Provisions

• Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country in which they have their habitual residence.
• For disputes with businesses, the place of jurisdiction is Vienna. For consumers, the statutory places of jurisdiction apply: consumers who live, habitually reside or are employed in Austria can only be sued at the court of the district where they live, habitually reside or are employed (§ 14 KSchG).
• Should individual provisions of these terms be or become invalid, the remaining provisions shall remain unaffected.
